2. Definitions

2.1 Purchaser: the person who buys an InchKeeper gift card.

2.2 Recipient: the person the Purchaser names to receive the gift card and Plot. The Recipient may be the Purchaser.

2.3 Plot Holder: the Recipient once a Plot has been allocated to them.

2.4 Gift card: the personalised digital greeting card we email to the Recipient.

2.5 Plot: an area of land of approximately one square inch on the Bandrum Estate, near Saline, Fife, identified by a unique plot number on the [Bandrum Estate plot plan held by the Seller].

2.6 Land Deed: the digital certificate that records the Plot Holder's name, plot number and the terms on which the Plot is held.

2.7 High InchKeeper: the honorary title given to each Plot Holder. It is not a legal, noble or official title.

3. What you are buying

3.1 An InchKeeper gift card is a digital product. It includes: (a) a personalised Scottish greeting card; (b) the allocation of one Plot to the Recipient; (c) a downloadable Land Deed; and (d) the Recipient's entry in our Register of High InchKeepers.

3.2 The Plot is a heritage and souvenir gift. It has no commercial value, can't be developed, and isn't sold as an investment.

3.3 Because of its size, the Plot is a "souvenir plot" and can't be registered in the Land Register of Scotland (Land Registration etc. (Scotland) Act 2012, s.22). The plot number is our own reference. It isn't an official land registration number. See our Note on Scots Law below.

3.4 Nothing is sent by post. All cards, deeds and communications are digital.

4. The Plot and the Plot Holder's rights

4.1 Each Plot is leased to the Plot Holder for 175 years from the date of allocation. That is the longest lease term Scots law allows (Abolition of Feudal Tenure etc. (Scotland) Act 2000, s.67).

4.2 There is no rent, fee or further charge for the Plot at any time. The purchase price is the only cost.

4.3 The lease is granted directly to the Recipient when the Plot is allocated.

4.4 If the Recipient is under 16, the Plot is held for them by [their parent or guardian] until their 16th birthday.

4.5 The Plot Holder's rights under the lease pass to their heirs or to the beneficiaries named in their will, for the rest of the lease term.

4.6 Each Plot has one Plot Holder. Plots can't be shared or split.

4.7 Your plot is leased for 175 years, the longest term Scots law allows, and passes down through your family. Towards the end of the term, Land Sales Direct Ltd will offer holders a new arrangement free of charge, so the land stays protected for generations to come.

5. Ordering and delivery

5.1 When you order, you personalise the gift card and enter the Recipient's name and email address. Please check these details carefully. You can correct any mistakes on the order review page before you pay.

5.2 A contract between you and us is formed when we email you an order confirmation.

5.3 We email the gift card to [the Recipient / you], usually within a few minutes of payment being confirmed.

5.4 When the Recipient opens the gift card, a Plot is allocated to them and their Land Deed becomes available to download.

5.5 We can't change a gift card after it has been sent. Only the fields you personalise at checkout can be customised.

5.6 We aren't responsible for delivery problems caused by an incorrect email address you entered, or by the Recipient's spam filter. If a card doesn't arrive, contact us and we'll help.

6. Prices and payment

6.1 The price of each gift card is shown on the product page, including VAT where applicable. There are no delivery charges.

6.2 Payment is taken in full at checkout through Stripe Payment Gateway.

6.3 You can buy as many gift cards as you like.

7. Your right to cancel and refunds

7.1 Gift cards are digital content delivered immediately. At checkout you'll be asked to agree that delivery starts straight away, and to confirm you understand that you will then lose your 14-day right to cancel (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, reg. 37). We'll confirm this in your order confirmation email.

7.2 After that, you can't cancel or get a refund just because you've changed your mind.

7.3 Your rights under the Consumer Rights Act 2015 are not affected. If your gift card or Land Deed is faulty, doesn't arrive, or isn't as described, contact us within [5 days] of your order. We'll resend it, fix it or refund you. See our Returns & Refunds Policy.

7.4 If we make a mistake in personalising your card, we'll correct it free of charge. We can't correct errors in details you supplied.

8. Looking after the land

8.1 The Bandrum Estate is held in thousands of separate Plots by different Plot Holders, so it can't be sold or developed as one piece of land. To keep it that way, Plot Holders and anyone visiting on their behalf must: (a) leave the Plot in its natural condition; (b) not dig, cultivate, plant, bury or remove anything on the Plot; and (c) not place or put up any structure, marker, sign, flag, tent, vehicle or other object on the Plot.

8.2 Plot Holders may visit the estate. When visiting, you must follow the Scottish Outdoor Access Code: stay on paths, leave gates as you find them, keep dogs under control, and respect the privacy and property of neighbours.

8.3 The hillside is steep in places and is working countryside. You visit at your own risk, and you are responsible for your own safety and for anyone with you. Nothing in this clause limits our liability for death or personal injury caused by our negligence.

9. Your personal data

9.1 We use your personal data, and the Recipient's, to process your order, deliver the gift card, allocate the Plot and keep the Register of High InchKeepers.

9.2 We share data only with the service providers who help us do this (for example payment, email and website hosting), and as required by law. We never sell personal data.

9.3 By entering the Recipient's details, you confirm you're happy for us to contact them to deliver the gift.

9.4 Full details, including your rights, are in our Privacy Policy.

10. Our liability

10.1 We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill.

10.2 We don't exclude or limit our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud, and for breach of your statutory rights.

10.3 Our total liability for any order is limited to the price paid for it, except as set out in 10.2.

10.4 We aren't responsible for delays or failures caused by events outside our reasonable control (for example email or internet outages).

11. Complaints

11.1 If you're unhappy with anything, please email shop@scottishgiftcards.com. We aim to respond within 5 working days.

12. General

12.1 We may update these terms from time to time. The version in force when you placed your order applies to that order.

12.2 If a court finds part of these terms invalid, the rest stays in force.

12.3 These terms are governed by Scots law. If you live elsewhere in the UK, you may also bring proceedings in your local courts.

12.4 These terms are available in English only.

Is holding a square inch of Scotland legal?

In Scotland, land ownership is normally recorded in the Land Register of Scotland, kept by Registers of Scotland. However, the Land Registration etc. (Scotland) Act 2012 (section 22) doesn't allow "souvenir plots" to be registered: plots "of inconsiderable size and of no practical utility".

To give InchKeepers real legal protection anyway, each Plot is leased to its holder under a binding contract for 175 years. That is the longest lease Scots law permits (Abolition of Feudal Tenure etc. (Scotland) Act 2000, section 67). In England a lease could run for 999 years, but Scots law doesn't allow that.

Each Plot has its own plot number, is recorded in our Register of High InchKeepers, and passes to the holder's heirs. There are no fees, rent or taxes to pay, ever.
